1. Acceptance of Terms
By accessing belancelife.com (the "Site") or purchasing our products, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Site. We may update these Terms at any time; continued use after changes are posted constitutes acceptance.
2. Eligibility
You must be at least 18 years old to make a purchase. By ordering, you represent that you are 18 or older and that the information you provide is accurate.
3. Products, Pricing & Orders
Prices are listed in U.S. dollars and exclude applicable sales tax, which is calculated at checkout. We reserve the right to change prices, limit quantities, correct pricing or typographical errors, and refuse or cancel any order — including orders we suspect are placed for unauthorized resale. Your order is an offer to purchase; our acceptance occurs when we ship. If we cancel an order after payment, we will refund it in full. Product images are representative; packaging may vary.
4. Health Disclaimer
Belance contains 180mg of caffeine per 12 fl oz can. It is not recommended for children, people sensitive to caffeine, or women who are pregnant or nursing. Statements on this Site have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease. Nothing on this Site is medical advice — consult a physician with questions about caffeine or dietary supplements. Where required, we provide warnings under California's Proposition 65.
5. Intellectual Property
The Site and its contents — the BELANCE name and logo, product designs, photography, video, text, and graphics — are owned by or licensed to Belance Energy and protected by trademark and copyright law. We grant you a limited, revocable, non-exclusive license to use the Site for personal, non-commercial purposes. You may not copy, reproduce, or use our marks or content without prior written permission.
6. Acceptable Use
You agree not to use the Site to violate any law; infringe others' rights; transmit malware; scrape, harvest, or index content or data by automated means; interfere with the Site's operation; or attempt unauthorized access to any system or account.
7. Third-Party Links
The Site may link to third-party sites and services (for example, our Instagram or payment processor). We are not responsible for their content or practices, and links do not imply endorsement.
8. Disclaimer of Warranties
EXCEPT AS EXPRESSLY PROVIDED IN OUR SHIPPING & RETURNS POLICY, THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BELANCE ENERGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
10. Indemnification
You agree to indemnify and hold harmless Belance Energy and its owners, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.
11. SMS Text Messaging Program
By providing your phone number and opting in through our website or sign-up forms, you consent to receive recurring automated marketing text messages (such as promotions, discount codes, and cart reminders) from Belance Energy at the number provided. Consent to receive these messages is not a condition of any purchase. Message and data rates may apply, and message frequency varies. Reply STOP to any message to opt out at any time, or reply HELP for assistance. We use a third-party platform (Klaviyo) to send these messages; your phone number and related consent information are handled in accordance with our Privacy Policy. Not all mobile carriers are supported, and we are not liable for delayed or undelivered messages.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Before filing any claim, you agree to contact us at laron@belancelife.com and attempt in good faith to resolve the dispute informally for 30 days. Any dispute that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Riverside County, California, and you consent to their jurisdiction. Small-claims matters may be brought in any court of competent jurisdiction.
13. California Consumer Notice
Under California Civil Code §1789.3, California users are entitled to know that complaints may be filed with the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
14. General
If any provision of these Terms is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and Shipping & Returns Policy, are the entire agreement between you and Belance Energy regarding the Site.
